Terms of Service

You must be at least 13 years old to use the Site. If you are under 18, you may use the Site only with the involvement of a parent or guardian. By placing an order, you represent that you are legally able to enter into a binding contract and that the information you provide is accurate.

• All products are handcrafted balloon decorations. Colors, sizes, and arrangements may vary slightly from images on the Site due to the handmade nature of the items and balloon material variability.
• Custom orders are based on the references and instructions you provide. We reserve the right to decline or modify any order.
• An order is confirmed once payment is successfully processed and you receive an order-confirmation email.
• We may cancel or refuse any order at our discretion (for example, suspected fraud, pricing errors, or inability to deliver).

• Prices are listed in U.S. dollars and may change at any time without notice. The price applied to your order is the one shown at checkout.
• Payment is processed by Stripe. By paying, you authorize the charge of the full order total, including delivery fees and applicable taxes.
• Promo codes are single-use, non-transferable, and have no cash value. Discounts may have minimum order requirements (e.g. minimum subtotal). Codes cannot be combined and may be revoked if abused.

• We deliver within New York City. Delivery zones, fees, dates, and time slots are shown at checkout.
• You are responsible for providing an accurate delivery address, contact phone, and ensuring someone can receive the order during the selected time slot.
• Risk of loss passes to you upon delivery to the address provided.
• Balloons are fragile and sensitive to heat, sunlight, and weather. Once delivered, we are not responsible for damage caused by environmental conditions, mishandling, or transportation by the recipient.

• Due to the perishable, handmade, and time-sensitive nature of balloon decorations, all sales are final once production has begun.
• Cancellation requests must be sent to order@fiaballoons.com at least 48 hours before the scheduled delivery date. Eligible cancellations will be refunded to the original payment method, minus any non-refundable fees.
• If an order arrives materially defective, contact us within 24 hours of delivery with photos. We will, at our discretion, offer a replacement, partial refund, or store credit.

By submitting text, images, or other content for custom orders, you represent that you own or have the right to use such content and grant FIA Balloons a non-exclusive, royalty-free license to use it for the limited purpose of producing your order. We will not produce content that is unlawful, infringing, hateful, sexual, or otherwise objectionable, and we may decline such orders without liability.

The Site and all content (text, photos, graphics, logos, and trademarks) are owned by or licensed to FIA Balloons and are protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

You agree not to: (a) use the Site for any unlawful purpose; (b) interfere with the Site’s operation or security; (c) attempt to gain unauthorized access to any account or data; or (d) submit false, misleading, or fraudulent information.

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIA BALLOONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.

You agree to indemnify and hold harmless FIA Balloons and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Site or products.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.

We may update these Terms at any time by posting the revised version on the Site with a new “Last updated” date. Your continued use of the Site after the update constitutes acceptance of the revised Terms.
